These Terms & Conditions (“Terms”) govern access to and use of the Rio Gay Guide website and the purchase, booking and use of products and services offered by Rio Gay Guide, including private tours, travel consulting, the Insider Pass and other digital products or services.
By completing a purchase or booking, you confirm that you have had the opportunity to review and accept these Terms and the policies applicable to your purchase.
These Terms should be read together with our Refund & Cancellation Policy, Digital Delivery Policy and Privacy Policy, which form part of the conditions applicable to our services.
Nothing in these Terms excludes, limits or waives any consumer right or other protection that cannot legally be excluded under applicable Brazilian law.
1. Service Provider
The products and services offered through this website are provided under the Rio Gay Guide brand:

Rio Gay Guide is an independent tourism and travel-information business.
2. Scope of Services
Depending on the offer selected, Rio Gay Guide may provide:
- private tourism experiences and tours;
- personalized travel consulting;
- itinerary planning and local recommendations;
- the Insider Pass;
- digital travel content;
- nightlife, event, beach, restaurant and destination information; and
- other tourism-related services expressly described on the website.
The exact scope, duration, inclusions, exclusions and price of a paid service are determined by the description displayed or communicated at the time of purchase or booking confirmation.
Services or benefits that are not expressly identified as included should not be considered part of the contracted service.
3. Accuracy of Customer Information
Customers are responsible for providing accurate and sufficiently complete information when making a purchase or booking.
This may include the customer’s name, contact information, number of participants, preferred date, relevant travel information and other information reasonably required to provide the requested service.
Rio Gay Guide is not responsible for delays or difficulties caused exclusively by materially incorrect or incomplete information supplied by the customer.
Customers should promptly notify us if relevant booking information changes.
4. Prices and Offers
Prices, inclusions and conditions are those displayed on the website or expressly communicated to the customer at the time the transaction is confirmed.
Promotional offers, discounts and special conditions may be subject to their own stated validity periods and availability.
Unless expressly stated otherwise, a quotation or availability inquiry does not constitute a confirmed reservation.
Obvious technical or typographical errors in prices or descriptions will be handled in accordance with applicable consumer law and will not be used to deprive customers of rights arising from a valid offer.
5. Currency and Payment
Available payment methods will be displayed during checkout or communicated during the booking process.
Prices may be displayed or quoted in Brazilian reais (BRL), euros (EUR) or another currency where appropriate.
When the customer’s payment method uses a different currency, the final amount appearing on the customer’s account may be affected by exchange rates, conversion methods, taxes or fees independently imposed by banks, card issuers, payment processors or financial institutions.
Such independently imposed charges are outside Rio Gay Guide’s control.
6. Private Tour Reservations
Unless different conditions are expressly communicated for a particular booking, a 50% deposit is required to secure a private tour.
A tour is considered confirmed only after:
1. availability has been confirmed by Rio Gay Guide; and 2. the required deposit or payment has been successfully received.
An inquiry, quotation, proposed itinerary or exchange of messages does not by itself secure a date.
Unless otherwise agreed in writing, the remaining balance is due no later than the beginning of the tour.
Cancellation, rescheduling and refund conditions are governed by our Refund & Cancellation Policy.
7. Number of Guests
A private tour booking applies to the number of participants confirmed at the time of reservation.
Any request to add participants must be communicated in advance and is subject to availability, vehicle capacity, safety requirements and possible price adjustment.
Rio Gay Guide may refuse additional unconfirmed participants where their inclusion would exceed the agreed capacity or materially alter the contracted service.
8. Starting Time and Customer Delays
Customers should be ready at the agreed meeting point at the scheduled starting time.
A delay caused by the customer does not automatically extend the scheduled duration or finishing time of the tour.
Where operationally possible, additional time may be offered subject to guide and transportation availability and any applicable additional-hour charge communicated to the customer.
If a customer’s delay makes part of the planned itinerary impractical, the itinerary may be reasonably modified.

9. Tour Duration and Additional Time
The contracted duration of a tour is the duration stated in the booking confirmation.
Reasonable time spent moving between locations, waiting in traffic or completing activities forming part of the agreed itinerary counts toward the tour duration unless expressly stated otherwise.
Additional time requested by the customer is subject to availability and may incur an additional charge.
No additional time is guaranteed unless expressly confirmed.
10. Tour Itineraries
Tour itineraries describe the intended experience but may need to be reasonably adapted to local conditions.
Possible reasons include:
- traffic or road closures;
- weather conditions;
- public demonstrations;
- security concerns;
- attraction closures;
- changes in opening hours;
- excessive queues;
- local authority restrictions;
- transportation interruptions;
- event changes; or
- other circumstances affecting the feasibility, quality or safety of the itinerary.
Where reasonably possible, Rio Gay Guide will offer an appropriate alternative.
A reasonable modification that preserves the essential nature and overall contracted duration of the service does not by itself constitute cancellation of the tour.
11. Weather
Rio de Janeiro is subject to changing weather conditions.
Tours generally operate during ordinary rain, cloudy weather, heat and other normal weather variations.
Where weather affects only part of the planned itinerary, the order, timing or location of activities may be reasonably adjusted.
Where conditions make an activity materially impractical or unsafe, Rio Gay Guide may propose an alternative itinerary or rescheduling.
Weather-related cancellation and refund conditions are governed by our Refund & Cancellation Policy.
12. Transportation
Transportation included in a private tour, where applicable, will be described in the specific offer or booking confirmation.
Depending on the service, transportation may be provided directly or through an appropriately engaged independent transportation provider.
Customers must comply with applicable vehicle-safety requirements and reasonable instructions provided by the driver or guide.
The type or model of vehicle may be substituted where reasonably necessary for operational reasons, provided that the replacement remains appropriate for the contracted service and number of passengers.
13. Tickets, Food, Drinks and Additional Expenses
Unless expressly stated as included in the offer or booking confirmation, prices do not include:
- attraction tickets;
- event, nightclub or venue admission;
- food;
- drinks;
- personal purchases;
- optional activities;
- gratuities; or
- other personal expenses.
Where Rio Gay Guide assists with a third-party reservation or purchase, the relevant third-party terms and cancellation conditions may also apply.
Any mandatory fees or expenses forming part of the advertised contracted service will be disclosed as required by applicable law.
14. Customer Conduct and Safety
Customers must comply with Brazilian law and behave in a manner that does not create unreasonable risk or disruption.
Customers must also follow reasonable safety instructions provided by guides, drivers, venues or relevant authorities.
Rio Gay Guide may refuse to begin or may terminate a service where a customer’s conduct:
- creates a significant safety risk;
- involves unlawful activity;
- constitutes harassment, threats, violence or discrimination;
- causes or threatens material property damage;
- seriously interferes with the service provided to others;
- involves excessive intoxication that makes continuation unsafe; or
- otherwise makes the safe or lawful continuation of the service unreasonable.
Any refund in such circumstances will depend on the facts of the case, the portion of the service already provided and applicable law.
Customers remain responsible for consequences resulting exclusively from their own unlawful, reckless or intentionally unsafe conduct.
15. Alcohol and Illegal Substances
Some itineraries may include venues where alcoholic beverages are available.
Customers are responsible for their own consumption and must comply with applicable age restrictions and Brazilian law.
Rio Gay Guide does not encourage or facilitate the purchase, possession or use of illegal substances.
A service may be interrupted where conduct involving intoxication or illegal substances creates a material safety or legal risk.
16. Personal Belongings
Customers are responsible for taking reasonable care of passports, mobile phones, wallets, luggage and other personal belongings.
Customers should verify that they have collected their belongings before leaving vehicles, restaurants, venues, beaches or other locations.
Rio Gay Guide is not responsible for loss, theft or damage arising exclusively from circumstances outside its control and not resulting from a failure in the contracted service.
Nothing in this section excludes any responsibility that cannot legally be excluded.
17. Health, Mobility and Accessibility
Customers should inform Rio Gay Guide before a tour of any mobility requirement or other practical accessibility need that may materially affect the itinerary or transportation arrangements.
This allows us to assess whether reasonable adjustments are available.
Customers remain responsible for determining whether ordinary tourism activities are suitable for their individual circumstances and for following professional medical advice applicable to them.
Rio Gay Guide does not provide medical advice or medical services.
18. Beaches, Hiking, Outdoor and Water Activities
Some recommendations or itineraries may involve beaches, trails, viewpoints or other outdoor environments.
Conditions in natural environments may change and may involve ordinary risks associated with weather, terrain, ocean conditions and other factors outside Rio Gay Guide’s control.
Customers must follow warnings, restrictions and instructions issued by guides, lifeguards, public authorities or other competent personnel.
No customer is required to participate in an activity that has not formed part of the contracted service.
19. Third-Party Businesses and Services
The website and our services may contain information or recommendations concerning independent hotels, restaurants, bars, clubs, saunas, events, transportation providers, attractions and other third-party businesses.
Unless expressly stated otherwise, a recommendation does not mean that Rio Gay Guide owns, operates or controls the third-party business.
Opening hours, prices, availability, admission rules, schedules, quality and operating conditions may change without notice.
Where a customer independently contracts a third-party service based only on a recommendation, that third party is responsible for its own contractual obligations and conduct.
Nothing in this section excludes any responsibility imposed on Rio Gay Guide by applicable law where the third-party service forms part of the service contracted from Rio Gay Guide or where Rio Gay Guide is otherwise legally responsible.
20. Nightlife, Events and Venue Admission
Recommendations concerning nightlife, parties, clubs, saunas, bars and other venues are based on information reasonably available at the relevant time.
Independent venues and event organizers control their own admission policies.
Admission may depend on circumstances such as:
- venue capacity;
- ticket availability;
- guest-list deadlines;
- identification;
- minimum age;
- dress code;
- security policies;
- customer conduct;
- event cancellation or rescheduling; or
- other rules imposed by the organizer or venue.
Unless admission is expressly sold or guaranteed as part of a specific offer, a recommendation, guest-list opportunity, discount or reference to a venue does not guarantee entry.
21. Insider Pass
The Insider Pass is a digital travel product containing the materials, recommendations and benefits described in the offer applicable at the time of purchase.
Because Rio de Janeiro’s tourism and nightlife environment changes frequently, recommendations, event information and selected partner benefits may be updated during the relevant period.
Individual third-party events, discounts, guest lists or benefits may become unavailable.
Unless expressly identified as a guaranteed component of the purchased offer, the availability of a particular independent event or partner benefit is not guaranteed.
Delivery and access are governed by our Digital Delivery Policy.
Cancellation and refund rights are governed by our Refund & Cancellation Policy.
22. Travel Consulting
Travel consulting may include personalized recommendations, itinerary planning, local guidance or other advisory services described in the relevant offer.
Recommendations are based on information reasonably available when the service is provided and on information and preferences supplied by the customer.
Unless expressly included, travel consulting does not constitute the purchase or reservation of third-party accommodation, transportation, tickets, events or other products on the customer’s behalf.
Third-party prices, availability and conditions may change after a recommendation is made.
Customers remain responsible for passports, visas, immigration requirements, travel insurance and other personal travel documentation applicable to their trip.
Cancellation and refund conditions are governed by our Refund & Cancellation Policy.
23. Website Information
Rio Gay Guide makes reasonable efforts to provide useful and accurate tourism information.
However, information concerning events, nightlife, restaurants, hotels, beaches, attractions, prices, opening hours, transportation and local conditions may change rapidly.
Time-sensitive third-party information should therefore be verified before relying on it.
The website’s informational content does not constitute a guarantee concerning the continued availability, quality, safety or operating conditions of an independent third-party service.
24. LGBTQ+ and Adult-Oriented Travel Information
Rio Gay Guide may provide information about LGBTQ+ nightlife, adult-oriented venues, cruising areas or other locations relevant to adult travelers.
Such information is provided for lawful informational and tourism purposes.
A reference to a location does not constitute a guarantee of safety, privacy, legality of every possible activity, presence of other individuals or any particular experience.
Users remain responsible for complying with applicable law, respecting consent and boundaries, exercising reasonable judgment and following local safety guidance.
25. Digital Delivery
Digital products are delivered according to our Digital Delivery Policy.
Customers are responsible for providing accurate contact information and contacting us if a purchased product cannot reasonably be accessed.
Technical or delivery problems attributable to Rio Gay Guide will be addressed in accordance with that Policy and applicable law.
26. Intellectual Property
Unless otherwise stated, original website texts, travel guides, itineraries, digital products, photographs, graphics, branding and other original materials are protected by applicable intellectual-property laws.
Purchasing a digital product grants the customer a limited, personal and non-transferable right to use the material for personal purposes.
Customers may not, without authorization or another applicable legal basis:
- resell paid content;
- reproduce it systematically for distribution;
- publish paid material publicly;
- share private access with unauthorized persons; or
- commercially exploit the material.
27. Personal Data and Privacy
Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.
Depending on the service, personal data may be processed by providers necessary to operate the website, process payments, communicate with customers or perform contracted services.

28. Refunds and Cancellations
Refund, withdrawal, cancellation, rescheduling, late-arrival and no-show conditions are governed by our Refund & Cancellation Policy and applicable law.
Nothing in these Terms removes a statutory consumer right that cannot legally be waived.
29. Events Beyond Reasonable Control
Services may be affected by events outside reasonable control, including severe weather, natural disasters, government restrictions, strikes, civil disturbances, public-safety incidents, major transportation interruptions, road closures or unexpected closure of essential attractions.
When such circumstances materially affect a contracted service, Rio Gay Guide will make reasonable efforts to offer an appropriate solution according to the circumstances, which may include an alternative itinerary, rescheduling, credit or refund as applicable.
This section does not limit rights that cannot legally be excluded.
30. Limitation of Responsibility
Rio Gay Guide is responsible for providing contracted services in accordance with applicable law.
To the extent permitted by law, Rio Gay Guide is not responsible for losses or consequences caused exclusively by:
- the customer’s unlawful, reckless or intentionally unsafe conduct;
- materially inaccurate information supplied by the customer;
- independent decisions made by third parties not under Rio Gay Guide’s control;
- circumstances outside reasonable control; or
- independent services contracted directly by the customer and not forming part of the service purchased from Rio Gay Guide.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law
31. Payment Disputes and Chargebacks
Customers who believe they have been incorrectly charged or have not received a purchased service are encouraged to contact Rio Gay Guide so that the matter can be investigated promptly.
Rio Gay Guide may respond to chargebacks or payment disputes using relevant transaction records, booking confirmations, communications, access records and evidence of service or digital delivery.
Fraudulent or knowingly inaccurate payment disputes may be contested through the applicable payment provider.
Nothing in this section restricts a customer’s legitimate right to challenge an unauthorized, fraudulent or improperly processed transaction.
32. Communications and Booking Records
Communications made through email, WhatsApp, website forms or other official channels may form part of the booking record.
Customers should review booking confirmations and promptly notify Rio Gay Guide of any material error.
Records reasonably necessary to document transactions, customer instructions, performance of services, refunds or disputes may be retained in accordance with our Privacy Policy and applicable law.
33. Changes to Services
Rio Gay Guide may modify the structure, presentation or availability of future services and products.
Changes affecting future purchases may be reflected in updated descriptions, prices or Terms.
A material change will not retroactively remove a right already acquired under a confirmed booking or purchase except where required by law or expressly agreed with the customer.
34. Changes to These Terms
These Terms may be updated periodically to reflect changes in services, business practices or legal requirements.
The latest revision date will appear at the beginning of this document.
The version applicable to a transaction will generally be the version made available when the relevant purchase or booking was confirmed, except where a later provision is required by law or validly agreed by the parties.
35. Relationship Between Policies
These Terms should be read together with:
- Refund & Cancellation Policy
- Digital Delivery Policy
- Privacy Policy
Each policy governs its respective subject matter.
If a provision of these documents conflicts with a mandatory provision of applicable law, the mandatory legal provision will prevail.
Nothing in one policy should be interpreted as removing a right expressly granted under another policy or applicable law.
36. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, it will be interpreted or limited to the extent legally permitted.
The invalidity of one provision does not automatically invalidate the remaining provisions.
37. Applicable Law and Dispute Resolution
These Terms and the services governed by them are subject to the laws of the Federative Republic of Brazil.
Customers are encouraged to contact Rio Gay Guide first so that questions, complaints or disputes can be reviewed and, whenever possible, resolved directly.
Nothing in these Terms restricts a consumer’s right to seek a competent court, consumer-protection authority or other remedy available under applicable law.
